We strongly reject the European Parliament’s attempt to interfere – letter to the European Commission

2023. 05. 31.

MEPs have sent the following letter to the European Commission’s President and Commissioners:

TO:

Ursula von der Leyen

President of the European Commission

Věra Jourová

Vice-President of the European Commission

Johannes Hahn

European Commissioner for Budget and Administration

Didier Reynders

European Commissioner for Justice

Brussels, 31 May 2023

Dear Madam President,

Dear Madam Vice-President,

Dear Commissioners,

Recently, the leaders of five political groups in the European Parliament wrote to you, once again expressing their concern about certain legislative developments in Hungary, alleging serious untruths. In their letter, they expressed their political expectation that the European Commission should not, under any circumstances grant Hungary access to the resources of the Recovery and Resilience Facility (RRF), citing certain planned legislative amendments in Hungary as a pretext.

Pursuant to Article 8 of Regulation 2020/2092/EU on the general conditionality for the protection of the EU budget, the European Commission has the obligation only to inform the European Parliament of any measures proposed, adopted or lifted, therefore the demand of the European Parliament’s political group leaders cannot in any way be interpreted as part of the conditionality procedure.

Legal certainty and the predictable functioning of the institutions are among the most important requirements of the rule of law. Interference by the political group leaders of the European Parliament in a matter outside their remit thus jeopardises the application of these general principles of law.

We firmly call on the European Commission to abide by the procedural rules laid down in the Regulation and reject the European Parliament’s attempt to interfere, which seeks to influence the European Commission to make a decision in line with its political position.

Yours sincerely,

Members of the European Parliament:
