The Advocate General of the Court of Justice of the European Union today proposed that the Court should dismiss the action brought by Hungary and Poland to annul the so-called financial conditionality instrument. The mechanism’s apparent purpose is to create the possibility for the European Commission to withdraw budgetary resources from Member States that do not comply with its biased ideological demands. The Fidesz delegation to the European Parliament rejects the argumentation of the Advocate General’s motion, which is based on flawed logic. We stand for the annulment of the rule of law conditionality regulation. We do not accept that Brussels abuses its power to blackmail Member States on political and ideological grounds by withholding budgetary resources due to Member States.
It is regrettable that the Advocate General of the Court of Justice of the European Union ignores in his opinion that the conditionalities regulation challenged by Hungary and Poland has an incorrect legal basis, that it contains serious legal errors and that it circumvents the objectives of the founding Treaties. The Fidesz delegation to the European Parliament rejects the erroneous reasoning of the Advocate General’s opinion, and we remain confident that the Court’s judgment, expected early next year, will correct these errors and base the decision solely on legal arguments and common sense.
As Fidesz MEPs, we will continue to stand up against blackmail masquerading as rule of law. We will defend the resources due to the Hungarian people, and we will use all means at our disposal to ensure that EU pressure does not jeopardize these resources.
